Terms of Service

1 Acceptance of Terms

By downloading, installing, or using Plantive you confirm that you are at least 13 years old and have the legal capacity to enter into a binding agreement. If you are using Plantive on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2 Description of Service

Plantive is a plant care application that provides:

• AI-powered plant identification via photo upload.
• Personalised watering schedules based on your plant's environment, local weather, pot type, soil, and light conditions.
• Care task management including reminders and completion tracking.
• Premium features including propagation guides and advanced care insights (available via subscription).

We reserve the right to modify, suspend, or discontinue any feature of the service at any time with reasonable notice.

3 Account Registration

To use Plantive you must create an account using a valid email address. You are responsible for:

• Keeping your account credentials secure.
• All activity that occurs under your account.
• Notifying us immediately at support@plantive.app if you suspect unauthorised access.

We use one-time password (OTP) authentication. You must have access to the email address associated with your account to sign in.

4 Subscriptions & Payments

Plantive offers a free tier and an optional paid subscription ("Plantive Premium"). Subscriptions are billed through the Apple App Store or Google Play Store on the terms you agreed to at purchase.

• Billing — charges are made to your App Store / Play Store account at confirmation of purchase and renew automatically unless cancelled.
• Cancellation — you may cancel at any time through your App Store / Play Store account settings. Access continues until the end of the current billing period.
• Refunds — refund requests are handled by Apple or Google under their respective policies. We do not issue direct refunds.
• Price changes — we will give reasonable notice of any price changes before they take effect.

5 Acceptable Use

You agree not to:

• Use Plantive for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse engineer, decompile, or extract the source code of the application.
• Upload content that is harmful, offensive, infringing, or misleading.
• Use automated tools to scrape, crawl, or abuse the API.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Interfere with or disrupt the integrity or performance of the service.

6 Intellectual Property

All content, features, and functionality of Plantive — including but not limited to the application code, design, graphics, text, and algorithms — are owned by Viva Apps Yazılım ve Danışmanlık Sanayi ve Ticaret Limited Şirketi or its licensors and are protected by applicable intellectual property laws.

These Terms do not grant you any right, title, or interest in the service other than the limited licence to use Plantive for its intended personal purpose. The Plantive name and logo are trademarks of Viva Apps and may not be used without prior written permission.

7 User Content

You retain ownership of any content you submit to Plantive, including plant photos, names, and care notes ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, royalty-free licence to store and process it solely for the purpose of providing the service to you.

We do not claim ownership of your User Content and will not use it for any purpose beyond operating Plantive. See our Privacy Policy for details on how content is handled.

8 AI-Generated Content

Plant identifications, watering recommendations, and care advice are generated with the assistance of AI models (including Anthropic's Claude). While we strive for accuracy:

• AI-generated plant identifications may not always be correct.
• Watering recommendations are estimates based on the information you provide — they are not a substitute for observing your plant directly.
• We are not liable for plant health outcomes resulting from following AI-generated advice.

9 Disclaimers & Limitation of Liability

Plantive is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, Viva Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of Plantive shall not exceed the amount you paid us in the twelve months preceding the claim.

10 Termination

You may delete your account at any time by contacting us at support@plantive.app. We may suspend or terminate your account if we reasonably believe you have violated these Terms, with or without prior notice depending on the severity of the violation.

Upon termination, your right to use the service ceases immediately. We will handle your data as described in our Privacy Policy.

11 Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via in-app notification or email. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of Plantive after changes take effect constitutes your acceptance of the revised Terms.

12 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ankara, Turkey.
